Casey v. Teachers’ Pension Plan Trustee Inc., 2019 NSSC 135 – Court Defers to Jurisdiction of Pension Plan Appeals Committee
Casey commenced an action, arguing that the NSPC and the Plan's Trustee, Teachers’ Pension Plan Trustee Inc. (the Trustee), had been negligent in not permitting her to apply for a disability pension. The NSPC and Trustee, in turn, submitted that the Court did not have jurisdiction to hear the case. In particular, the defendants argued that the matter fell within the exclusive jurisdiction of the TPA, and under the TPA there is an Appeals Committee for individuals who do not agree with an NSPC decision regarding eligibility for benefits . . .
